I-601A Provisional Waiver

The Provisional I-601A waiver was created to assist certain individuals who are required to leave the United States in order to attend their Green Card Interviews at a Consular Post abroad, but who have accrued more than 180 days of unlawful presence in the United States. The waiver which was created and now expanded, for the spouses of U.S. Citizens and Lawful Permanent Residents, and the sons and daughters of US Citizens and Lawful Permanent Residents who have accrued more than 180 days of unlawful presences in the United States gives these individuals the ability to apply for a waiver waiving their unlawful presences in the United States and allowing them to return to their families.

Applicants must demonstrate that a qualifying relative will face extreme hardship as a result of separation. “Qualifying relative” and “extreme hardship” are terms that are very complex and as such individuals looking to apply should consult experienced immigration attorneys.
