Both parents have legal duty to provide financial support for their children. The court may order either or both parents to make regular payments to cover a child’s living and medical expenses. This payment is known as child support.
The child support order may be part of a divorce action, paternity action or separate child support action. Generally, the court sets the amount of child support based on each party’s income, the parent’s education level, and the amount of time the child is in each party’s care.
In order to determine the appropriate amount of child support, all California courts must follow the “statewide uniform child support guideline.”
Modification of Child Support
Child Support can also be modified when certain circumstances have changes. Changes in a parent’s employment or changes in a child’s education or health requirements can result in child support being modified to properly meet the new circumstances of both the parents and the child.
