Summary Dissolution

Summary dissolution is a relatively straightforward inexpensive procedure for ending a marriage or a domestic partnership. The ultimate goal of marital/domestic partnership dissolution is just as the name implies. No formal court hearings or appearances are required and a judgment of dissolution may be entered within 6 months after filing a joint petition.

In order to qualify for summary dissolution:

  1. You and your spouse must have been married for less than 5 years
  2. You and your spouse have no children
  3. You and your spouse do not own any land or buildings
  4. You and your spouse do not rent any land or building except for the place you live
  5. You and your spouse do not owe more than $6,000 for debts acquired during marriage
  6. You and your spouse have less than $40,000 worth of property
  7. You and your spouse have agreed that neither spouse will receive spousal support and you have a signed agreement that divides your property and debt
  8. Additionally, you or your spouse must have lived in California for at least 6 months and in the county where you file for summary dissolution for the last 3 months
