In California, either parent can have custody of the children or the parents can share custody. The judge makes the final decision about custody and visitation but generally will approve the parenting time that both parents agree on.
Two types of child custody:
- Legal custody means that parents make important decisions such as health, education and welfare.
- Physical custody means that parents make decision as to who the children live with.
These custody formats can be joint where both parents share the right and responsibility to make important decisions or sole, where only one part has the right and responsibility to make such decisions.
